Insurance companies do not care about losing or winning one case. All they care about is terrorizing and destroying injured workers under the pretense they are fighting fraud. In reality their main goal is to discourage other injured workers from filing claims.

The insurance business is based in something we call in mathematics "Probability". They assume if the scare tactic works with 25% of potential cases or any other percentage then they won.

Insurance companies also work with some media production companies to produce documentaries about high profile cases of fraud and air them at times to frighten injured workers from filing claims thinking they would be accused of fraud.

Today I saw Skilling (ex-ENRON CEO) in handcuffs, I hope the day will come when the rest of the crooks like him are are handcuffed.

: : Hi! I just wanted to let you know (especially Melanie and Copdaddy) that I had a comp trial this morning. I was like a hearing, but a little more involved. I was questioned by my attorney and the judge at length about my job activities and how they affect my hands. Then my boss testified to the same (she was a witness for the insurance compnay, though her testimony helped me and not them!). After multiple questions by the insurance company's attorney the judge declared that regardless of what else the insurance company had to say, or what they wanted to do, he was ruling on my case. He also said I gave the most impressive testimony he's ever heard and it was quite clear to him that my job is highly repetitive and my injuries are from my job and nothing else. As I described my job duties, my maneger was nodding her head in agreement to everything I had to say, and their attoenry sat where with him mouth open. After it was all done he told me is was the most cut and dry case he'd ever seen and proceeded to ask why they were f***ing with me. He couldn't believe they were hassling me so much. He also told me not to worry too much about an appeal because he feels the judge will slap them with a fine for a frivolous appeal. Needless to say, everything was in my favor and I can finally move on with getting the medical treatment I need and deserve. I spoke with my manager afterwards and she said the insurance company never prepared their attorney. He had no medical records on me, they never filled him in on what my job entails... he basically went there with nothing. In the end he wished me luck and told me to get all of the care I need and to get a new job. He was actually a nice guy and I liked him. I kind of feel badly that they threw him into a lion's den with nothing to way to defend himself (or them). It would have no good any way because my attorney and I were more than prepared for anything that came up, but he never stood a chance. So, now I'm off to schedule nerve testing... wish me luck!

: Congratultions Theresa, I don't understand why companies and insurance companies go to these lenghts when they know that what you were doing for them caused your injury. Don't worry about the appeal because the next judge will agree with the judge that found in your favor. Now go get the test you need to find out exactly what the problem is with your hands.
