I am now going for workers comp and seen somewhere else where they will not allow my claim since my insurance already paid part of my medical bills. I still have a trigger finger that needs operated on, workers comp has allowed both claims, but my employers MCO and my employer have denied the claim, so I am waiting for a state hearing , Meanwhile my employers MCO have offered me a settlement of $1500. So my question is can I be denied workers comp for already having insurance involved. I tried to get workers comp involved earlier before my surgery, but the human resource person in so many words said it wasnt work related, and after my the Dr. I'm seeing now said that it is work related I was a little more forceful in getting workers comp involved. Any help would be greatly appreciated. : : Thank you, : Bruce your company doesn't want to use WC cause their rates go up. So thats why they are fighting you. If you have developed trigger finger after your CT surgery, thats an occurance that happened since you've been back on the job. Did you report the trigger finger to your boss within the 30 day time limit? If your CT surgery was a success and you worked for a long while then all the sudden developed trigger finger, then I say you will have a good chance in front of the judge. I will have to admit though that going thru WC isn't fun. They are so slow and everything has to approved before hand. Your meds, doctors visits and surgery. If I knew what I knew now, I would of used my own personal insurance even having to pay co-pays. Go to your hearing and let the judge know how and when you developed the trigger finger, then you'll probably be approved, only if they can't tie the trigger finger to the CT. Best of luck to you. Please let us know how things turn out. Melani Thanks for the reply. The trigger finger was part of my original complaint and I just assumed it was part of the CTS, and it wasnt until about my 3rd checkup my doctor said it was trigger finger and seperate from CTS. I have since received a Cortizone shot for my trigger finger and it helped for about the first week and now Im still having problems with it. Again thank you for your help. Bruce |
